Mobile/SMS/MMS Terms
Legal Entity Disclosure. The Tournament House is a brand of Magnitude Equity Partners LLC, a Texas limited liability company (“we,” “us,” “our”). These Mobile Terms govern your enrollment in and use of our promotional and transactional text messaging program (the “Program”).

1) Program description
The Program may send you transactional messages (e.g., order confirmations, shipping updates) and promotional messages (e.g., offers, new releases, cart reminders) from The Tournament House at the mobile number you provide.
2) Enrollment & consent
By opting in—such as checking a box at checkout, submitting a form, entering your number in a pop-up or footer form, or texting a keyword—you authorize us to send SMS/MMS messages to the number you provided. Consent is not a condition of purchase.
You represent that you are the account holder or have the account holder’s permission for the enrolled number, and that you will promptly notify us if you change numbers.
3) Message frequency & fees
Message frequency varies; typical promotional cadence is 4–8 messages per month, plus transactional alerts as applicable. Message & data rates may apply.
4) Help & opt-out (STOP)
To get help, reply HELP. For example: “HELP for help.”
To opt out, reply STOP at any time. We also honor common synonyms (e.g., STOPALL, CANCEL, END, QUIT, UNSUBSCRIBE). After you send STOP, you’ll receive a final message confirming your opt-out, and no further messages will be sent unless you re-opt in.
5) Eligibility & your responsibilities
- Program is intended for U.S. residents, 18 years and older.
- You are responsible for keeping your contact details accurate and for any charges imposed by your mobile carrier.
- Do not enroll a number you do not own or control.
6) Privacy; “Do Not Sell or Share” (CPRA)
Our Privacy Policy explains how we collect, use, and disclose personal information, including phone numbers and SMS engagement data. For California and other applicable state privacy laws, you may exercise opt-out rights (including “do not sell/share” for cross-context behavioral advertising) at Your Privacy Choices. We also honor Global Privacy Control (GPC) signals where legally required.
7) Supported carriers & delivery
Delivery of SMS/MMS messages may be affected by your carrier’s network. Participation is not required on all carriers or devices, and the Program may be unavailable in certain areas. Carriers are not liable for delayed or undelivered messages.
8) Prohibited use
- Do not use the Program to send or facilitate unlawful, harmful, harassing, or infringing content.
- No automated enrollment or enrollment of third parties without consent.
- No reverse engineering, scraping, or interference with the Program or related systems.
9) Third-party platforms & numbers
We may operate the Program via SMS providers and through short codes, 10DLC long codes, or toll-free numbers. Those providers’ terms and policies may also apply. We are not responsible for acts or omissions of carriers or platform providers.
10) Warranty disclaimers; limitation of liability
The Program is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties (express or implied) regarding the Program, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, our total liability for any claims arising from or relating to the Program will not exceed the greater of (a) amounts you paid to us for the relevant products in the 12 months preceding the claim, or (b) $100. We are not liable for any indirect, incidental, special, consequential, or punitive damages.
11) Governing law; arbitration; class-action waiver
These Mobile Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Any dispute or claim arising out of or relating to the Program will be resolved by binding arbitration on an individual basis, under the rules of the American Arbitration Association (AAA) or JAMS, before a single arbitrator in Travis County, Texas. Class actions and class arbitration are not permitted. If this arbitration agreement is found unenforceable, the exclusive venue will be the state and federal courts located in Travis County, Texas, and you consent to their jurisdiction.
12) Changes to these Mobile Terms
We may update these Mobile Terms from time to time. Changes are effective when posted on this page with the “Last updated” date above. Your continued participation after changes constitutes acceptance.
